Data Center Terms & Conditions

GIL DATA CENTER services/Email/DNS Website, Virtual private servers (VPS), Storage Security and other related GIL Cloud services, Client shall be solely responsible for undertaking measures to:

(1) prevent any loss or damage to Client`s website or server content;
(2) maintain independent archival and backup copies of the website or server content; and
(3) ensure the security, confidentiality, and integrity of all Cloud / data center hosted content transmitted through or stored on our servers.

GIL DATA CENTER services/Email/DNS / Website/Server/VPS Content. Client shall be solely responsible for providing, updating, uploading and maintaining the platform and any and all files, pages, data, works, information and/or materials on, within, displayed, linked or transmitted to, from or through your platform or server including, but not limited to, trade or service marks, images, photographs, illustrations, graphics, audio clips, video clips, email or other messages, meta tags, domain names, software and text.

Client acknowledge and agree that in the course of providing you with technical assistance, it may be necessary for our support staff to modify, alter or remove the content of your hosted product.
Client website or server content shall also include any registered domain names provided by Client or registered on behalf of Client in connection with the Hosting Services.

If access to a third-party hosting website is required in the provision of any Service, Client represent and warrant that you are authorized to provide us with access to the third-party hosting account for the purposes of this Service Agreement. Client here by agreed that retaining sole contractual and any other legal or fiduciary responsibilities related to Client`s third-party hosting account.

If Client request that GIL should install any Third Party Software (defined below) not provided as part of the Hosting Services, you represent and warrant that:
(1) You have the right to use and install the Third Party Software,
(2) You have paid the applicable licensing fees for the Third Party Software, and
(3) The Third Party Software does not and shall not infringe on the intellectual property rights of any other person or entity.

Abusive Activities and Other Threats.
You acknowledge and agree that you may not use our servers and services , your platform/website/servers/ as a source, intermediary, reply to address, or destination address for mail bombs, Internet packet flooding, packet corruption, denial of service, or other abusive activities that threaten the stability of our network or will damage the systems of, or cause a disruption of internet services to, Globe Internet, GIL`s customers, or third-parties. Server hacking or other perpetration of security breaches is prohibited and we reserve the right to remove sites containing information about hacking or links to such information.

Use of your website as an anonymous gateway is prohibited.
We prohibit the use of software or scripts run on our servers that cause the server to load beyond a reasonable level, as determined by us. You agree that we reserve the right to remove your website temporarily or permanently from our servers if you are in violation of this Service Agreement and/or there are activities that threaten the stability of our network.

You acknowledge and agree that all websites/CLOUD services associated with your hosting account may be removed if one website is in violation of this Service Agreement.

You further acknowledge and agree that Globe internet reserves the right to scan your hosted account for malicious content (e.g., malware), and that, in the event any such content is discovered, it may be removed in Globe Internet's discretion for security purposes.

Storage and Plan Limits.
All Web Hosting and WordPress Hosting plans, including the unlimited plans, are subject to a limit of no more than 250,000 inodes per account for Linux® hosting accounts. The plans are also limited to no more than 1,000 tables per database and no more than one gigabyte of storage per database.
Any account or database that exceeds these limits may be issued a network violation warning and will be required to reduce the number of inodes, files and folders, tables or gigabytes (as the case may be), or maybe temporarily or permanently suspended, in our sole discretion.
All Linux hosting plans are subject to the following limitations: no more than
a) 25% of one CPU core;
b) 512MB of RAM;
c) 100 website connections;
d) 100 active processes;
e) 1 MB/s disk IO.

In the event these limitations are exceeded, your site may slow down or not be served until more resources are added. More resources may be added for additional fees.

  1. Globe Internet is not responsible for training Customer or Customer's employees on the use of their respective clients.
  2. Globe Internet is not responsible for troubleshooting problems not directly related to the Services and the Company's equipment, facilities, or servers.
  3. Company is not responsible for maintaining and renewing Customer's software licenses, domain names, MX records or other DNS-related functions if Customer's domain name is not hosted by the Globe Internet.
  4. Globe Internet is not responsible for Customer's domain being listed on any third-party blacklist or suppression list not under Globe Internet`s direct control.
  5. Cloud services provides from GIL are based on Opensource Free to use / GENERAL PUBLIC LICENSE category, other specific software installed on CLOUD facilities will not be maintain by the company and client must have full rights to use them and take full ownership and responsibility for them.
  6. Globe Internet is not responsible for troubleshooting or correcting any problem with Customer being able to send or receive email to or from a third party due to blacklists, suppression lists, third party software or firewalls, network security settings or any other factor not directly under Globe Internet 's control.
  7. Company is not responsible for troubleshooting or correcting any problem with connectivity or access related issues may cause by various faults not directly under Globe Internet 's control.

1 Excessive Use of Services

  1. Company may impose an additional charge or a restriction of services at any time that Customer's use of the Services imposes a considerable effect on Company resources or system performance. Company shall have sole discretion as to what constitutes excessive use and what activity is considered a violation of either the Globe Internet Acceptable Use Policy, or level of service that the Customer is currently using.
  2. Company is responsible for monitoring such excessive use for the account as a whole, and has no responsibility to identify a Customer's individual end-user, employee, or other agent who may or may not be responsible for the excessive use of services. Cloud services, Hosting services Shall not use to distribute Spamming ,Viruses , hacking tools Or any type of malwares, commercial or copyrighted materials.
  3. Globe Internet will not be able to held responsible or in charge on such cases and will not take responsibility of any miss use of the platform.
  4. Globe Internet will not be able to held responsible or in charge of any data loss caused by various threats. Customer must take backups regularly , and provide antivirus/virus guard firewall and other security software. The licenses or any financial facilities for those appliances will not be maintain by the company. Any activity of discrimination cause by the end users from customers end shall take full control and responsibility, Globe Internet hosted service shall not use for spamming or shall not use for any other activity from original requirement. And GIL will have full rights to terminate or suspend the account in such case.
  5. Globe Internet will exercise no control whatsoever over the content of the information passing through the Cloud services, network, email, web site.

Warranties

  1. Globe Internet makes no warranties or representations of any kind, whether expressed or implied for the service it is providing.
  2. Company also disclaims any warranty of merchantability or fitness for any particular purpose and will not be responsible for any damages that may be suffered by Customer, including loss of data resulting from delays, non-deliveries or service interruptions by any cause or errors or omissions of Customer.
  3. Use of any information obtained by way of Company is at Customer's own risk, and Globe Internet specifically denies any responsibility for the accuracy or quality of information obtained through its services.
  4. Connection speed represents the speed of an end-to-end connection. Globe Internet does not represent guarantees of speed or availability of end-to-end connections.
  5. Customer shall use any Internet sevice provider to gain access to the Virtual private server hosted at Globe Internet, Speed or quality of service between end-to-end shall not guaranteed by Globe Internet. Globe Internet specifically denies any responsibilities for any damages arising as a consequence of such unavailability.

Antivirus, Trojan, Malicious etc Code Disclaimer

Globe internet email servers make use of enterprise class antivirus software in order to protect the server and detect virus-infected email messages. Infected email messages will be handled per Company policy and preferences prior to the customer receiving the messages. Additional antivirus options are available and the Customer may configure these options for inbound and outbound email antivirus scanning in their Shared Email Hosting Services control panel.

Due to the nature of virus, trojan, and other malicious code dangers, Company makes no warranty that these features will detect, delete, or otherwise protect Customer from these dangers. Customer is responsible for implementing their own internal policies and procedures for opening potentially dangerous attachments, and is encouraged to install antivirus software on all access points or computers using Company Shared Email Hosting Services.

Antivirus protection on VPS.

We, Globe internet Ltd shall not responsible for providing Antivirus guard or internet security product with Virtual private servers, Client will be responsible for obtaining and deploying such security measures on the Virtual private server/s, in any case of virus/malware infection on the Virtual private server/s from internet/files content or any other method, GIL will not be responsible for the any sort of damage.
